APS response to NSW Workers Compensation Legislation Amendment Regulation 2026 consultation

The APS is pleased to respond to the NSW Workers Compensation Legislative Amendment Regulation 2026 consultation. While the APS supports the need for reforms to enhance Scheme sustainability, we raise concerns that reforms may reduce injured workers' access to treatment. 

Key recommendations include:
•    Continue investing in psychologically safe workplaces and prevention strategies, including evaluation of workplace mental health initiatives. 
•    Remove detailed “reasonable and necessary” treatment rules from the regulation and instead provide advice in guidelines, preserving clinicians’ professional judgement. 
•    Ensure evidence-based treatment remains accessible and avoid overly restrictive exclusions 
•    Develop strategies to support psychologists and other providers during implementation to prevent provider withdrawal from the scheme.
