Decision making capacity and the frontal lobe paradox

Overview

This presentation walks through a complex case involving a patient with an ABI and alcohol use disorder, whose decision making capacity was assessed twice — with conflicting conclusions. The case raises practical questions about the limits of clinical interview based capacity assessment, the role of neuropsychological evaluation, and how to operationalise "use and/or weigh" when real-world functioning and interview performance don't align. Relevant case law and literature will also be discussed.

This event will be an opportunity to discuss a complex decision-making capacity case. The case conference is aimed at neuropsychologists and neuropsychology trainees.

Learning Outcomes

  • Describe the role and limits of clinical interviewbased capacity assessment in patients with frontal lobe dysfunction.
  • Understand the role of neuropsychological assessment in informing decision-making capacity determinations.
  • Reflect on how to operationalise the "use and/or weigh" criterion when interview performance and real-world functioning are discrepant.
