Terms and conditions of use - CPD and Events Finder

Who can advertise?

The opportunity to advertise an event in the APS CPD and Events Finder is open to Colleges, Branches and Interest Groups (APS Member Groups), individual APS members and also non-APS members (all of the above being Advertisers).

Advertising Fee

Where an advertising fee is payable, the indicative fee will be inclusive of GST.  Services supplied to Advertisers outside of Australia are not subject to GST.  The advertisement of APS Member Group events will not attract an advertising fee.  If any governmental agency imposes a duty, tax, fee or other liability on the advertising service provided that is not otherwise provided for in the amount payable, the Advertiser will be required to pay it.

Tax Invoice/Receipt

At the end of the payment process for the advertising fee, the Advertiser will be presented with a tax invoice/receipt on-screen. The page can be printed for the Advertiser’s reference, the Advertiser will be sent an e-mail confirming the transaction. The email will include the tax invoice as an attachment.

Credit card

Payment for advertising fees in the CPD and Events Finder can be made by entering the Advertiser’s entire credit card number via the APS secure server which encrypts all submitted information.  In the event of unauthorised use of the credit card, the Advertiser must notify his or her credit card provider in accordance with its reporting requirements.  The APS will not be liable for unauthorised credit card use.

More than one location or date

Where an event is scheduled to be conducted in more than one geographic location or repeated on another date at the same location, an additional (but lesser) fee will apply in respect to its advertisement in each of the locations or on each of the dates.

Cancellation and deactivation

Once an advertisement for an event for the APS CPD and Events Finder is paid for, approved and published, there is no entitlement to a refund of the advertising fee.  Advertisers, nevertheless, will still be able to deactivate their event online should it be cancelled after the event’s publication.  If, for whatever reason, an advertisement for the APS CPD and Events Finder is not approved, the Advertiser will be entitled to a full refund of fees paid.  In some circumstances, at the discretion of the APS, a processing fee of up to $50.00 may be charged, but shall not be applicable to APS Member Groups Events nor to those of individual APS members.

Accurate information

Event information submitted by Advertisers must be accurate at the time of submission and conform to the submission guidelines governing the APS CPD and Events Finder.  For the avoidance of doubt, the APS CPD and Events Finder must not be used by Advertisers for any purpose that is or may be unlawful.

Advertising for a proper purpose

For whatever reason, the APS reserves the right to decline an advertisement or to deactivate an advertisement of an event at any time (including after publication) for any reason in its sole discretion, including but not limited to, for the purpose of protecting the integrity of the psychology profession and psychologists generally and of the APS Events Calendar website in particular.  In this respect, and for the avoidance of doubt, the APS CPD and Events Finder must also not be used by Advertisers for any purpose that is or may be unlawful.

Advertisers release

Advertisers, with the exception of an APS Member Group, release, discharge and hold harmless the APS and its officers, employees and agents from any and all claims, demands or causes of action arising as a result of the advertisement of the event in the APS CPD and Events Finder and/or the Advertiser’s association with or participation in the event so advertised.

APS not liable for links

The APS will not be liable to the Advertiser for any link contained in the advertisement provided by the Advertiser following publication or for any damages or loss arising in any way out of or in connection with or incidental to any information or third party service provided via a link.  Linked sites are not under the control of the APS and the APS is not responsible for the contents (including the accuracy, legality or decency) of any linked site.  The inclusion of any link does not imply the endorsement by the APS of the linked site nor is the APS responsible for the copyright compliance of any linked sites.

Privacy policy

The APS may need to collect an Advertiser’s personal information in relation to advertising in the APS CPD and Events Finder and the processing of the relevant fee payable.  A full copy of the APS Privacy Policy is accessible through the website at www.psychology.org.au/privacy save and except where an APS Member Group is the Advertiser and organiser of an advertised event, an Advertiser otherwise assumes full responsibility and liability for the secure and confidential collection, use and storage of personal information in respect of that event.

No warranties

The APS CPD and Events Finder Website may be accessed throughout Australia and overseas.  The APS makes no representation that the material on the site complies with the laws of any country outside Australia.  If an Advertiser accesses the Website from outside Australia, he or she is responsible for ensuring compliance with all applicable laws in the place he or she is located.

Governing law

Disputes which may arise as a result of advertising in the APS CPD and Events Finder shall be, if not satisfactorily resolved by the parties, adjudicated by the courts having jurisdiction in the State of Victoria, Australia and in accordance with the laws in force in the State of Victoria, Australia.
