TERMS AND CONDITIONS

APS MEMBER PSYCHOLOGISTS

PsychEngage

  1. The Australian Psychological Society Ltd (“APS”) provides the PsychEngage Platform that enables psychologists to receive booking requests from potential clients and to contact the potential clients concerning an initial consultation booking.
  2. To access the PsychEngage Platform a psychologist must have a current Premium Listing on the Find A Psychologist  APS website.
  3. The psychologist acknowledges that each potential client booking request through the PsychEngage shall be sent to several psychologists at the same time and it is the responsibility of each individual psychologist to respond to such booking request in accordance with these Terms and Conditions.
  4. Subject to compliance with these Terms and Conditions the APS grants a psychologist a limited, non-exclusive and revocable licence to use and access the PsychEngage Platform for the specified period.
  5. The APS through the introduction of booking requests from potential clients to psychologists via the PsychEngage Platform does not act as an agent, employee or partner of the psychologist and does not warrant or guarantee that the PsychEngage Platform will assist with productivity or increase the income or efficiency of the psychologist.
  6. The psychologist upon receiving an introduction booking request via the PsychEngage Platform shall endeavor to reply as soon as is practicable to the potential client and if appropriate commence a client/psychologist contractual relationship.
  7. The APS has no obligation to resolve any dispute between a psychologist and a potential client or client introduced via the PsychEngage Platform.
  8. The APS retains ownership of all rights including intellectual property in the PsychEngage Platform.
  9. The APS may amend these Terms and Conditions of the PsychEngage Platform at any time by email notice to the psychologist or by publishing on the APS website and the psychologist agrees to be bound by the Terms and Conditions as amended.
  10. The psychologist agrees to upload full and accurate details to the PsychEngage Platform and to update as necessary covering contact details, availability and specialty areas.
  11. The APS shall maintain privacy of information and data received on the PsychEngage Platform in accordance with its Privacy Policies save that the APS may collect de-identified analytical data for reporting purposes on the operation of the PsychEngage Platform.
  12. The APS shall maintain the PsychEngage Platform and shall endeavour to correct system errors or faults in the PsychEngage Platform as reasonably practicable but shall not be liable in any way for any loss arising out of or from any such errors of faults.
  13. The psychologist agrees to maintain the security of their login and access to the PsychEngage Platform and any breach shall be the responsibility of the psychologist.
  14. The psychologist may during the period of the licence notify the APS that they wish to cease their use and access to the PsychEngage Platform and the APS shall terminate such licence.
  15. The APS reserves the right to terminate the licence of a psychologist to use and access the PsychEngage Platform should the psychologist breach any term or condition.
  16. In registering and using the PsychEngage Platform the psychologist agrees that they have read, understood and agreed to be bound by these Terms and Conditions.
